Recapito

Terms of Service

These Terms govern your use of Recapito services, including CallPlan, CallPlan Essentials, AI calling agents, related software, integrations, and support services.

Last updated: August 12, 2026

Please read these Terms carefully. By starting a trial, activating a service, submitting onboarding information, or continuing to use a Recapito or CallPlan service, you agree to these Terms.

1. Services

Recapito provides practical artificial intelligence, communications, automation, integration, and related software services. CallPlan and CallPlan Essentials are Recapito products.

Depending on the service you select, features may include AI call handling, caller information capture, call routing or transfer, missed-call recovery, reporting, scheduling integrations, and other communications or automation features.

Features may vary by plan, configuration, integration, telephone provider, or customer requirements. We may improve or modify features as the service develops, provided that we do not materially eliminate the core service you are paying to receive without reasonable notice.

2. 30-Day Trial

Unless a different written offer applies, new CallPlan Essentials customers receive a 30-day trial. The trial is intended to give you an opportunity to test your configured AI agent and determine whether the service is appropriate for your business.

Your trial begins when your service or agent is made available to you for testing or use, unless we state a different start date in writing.

After the 30-day trial: unless you cancel before the trial ends, the monthly subscription amount presented when you signed up will be charged to your payment method and your subscription will continue on a month-to-month basis until cancelled.

A trial may be limited to one trial per customer, business, or account. Recapito may decline or discontinue a trial where we reasonably believe the trial is being abused or used to circumvent payment obligations.

3. Subscription Billing and Payment

After any applicable free trial, subscription fees are billed monthly in advance at the rate shown in your order, signup page, invoice, or other written offer. By providing a payment method, you authorize Recapito and its payment processor to charge recurring subscription fees and any other charges you have expressly approved.

Your subscription automatically renews each month until cancelled. You are responsible for maintaining a valid payment method and current billing information.

Fees are exclusive of taxes unless we expressly state otherwise. You are responsible for applicable sales, use, telecommunications, or similar taxes that Recapito is legally required or permitted to collect.

If a payment fails, we may retry the charge, contact you for updated payment information, suspend affected services, or take other reasonable steps to collect amounts due.

4. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current monthly billing cycle. You may continue using the paid service through the end of that billing cycle, subject to these Terms.

Unless required by law or specifically stated otherwise in writing, amounts already paid for a monthly billing cycle are not prorated or refunded when you cancel during that cycle.

You may cancel your subscription by emailing support@recapito.io. To avoid the first monthly subscription charge following a trial, your cancellation request must be received before the 30-day trial period ends. To avoid a subsequent monthly charge, your cancellation request must be received before your next scheduled billing date.

5. Onboarding and Agent Configuration

Your CallPlan agent is configured using information you provide during onboarding and through subsequent instructions. This information may include business hours, services, staff, policies, pricing guidance, transfer preferences, scheduling rules, frequently asked questions, terminology, and other information relevant to your callers.

You are responsible for providing information that is accurate, current, lawful, and appropriate for your business. You should notify us when important information changes so that your configuration can be updated where necessary.

6. Artificial Intelligence Services

CallPlan uses artificial intelligence and automated systems to interact with callers and perform configured tasks. These systems are designed to provide useful, consistent responses based on your approved business information and configuration.

AI systems are not perfect. Although errors may be uncommon, an AI agent may misunderstand a caller, provide an incomplete or inaccurate response, fail to follow an instruction as expected, misinterpret information, or experience a technical problem.

AI-generated or AI-delivered information should not be treated as a substitute for professional judgment where legal, medical, financial, safety, emergency, or other high-stakes decisions are involved.

CallPlan is not an emergency response service and must not be relied on to contact police, fire, emergency medical services, 911, or any other emergency service.

7. Testing Your Agent

We strongly encourage you to test your AI agent during the trial and periodically after launch. Your trial is specifically intended to give you an opportunity to call the agent, ask representative questions, test transfers and workflows, and confirm that responses reflect the information and instructions you provided during onboarding.

You are responsible for evaluating whether the agent's behavior is appropriate for your business before directing production call traffic to it and for continuing to monitor the service as your business information, policies, or needs change.

8. Your Responsibilities

You agree to:

  • provide accurate and lawful information for your agent configuration;
  • test the service before relying on it for customer-facing operations;
  • review important business rules, transfers, scheduling behavior, and other configured workflows;
  • maintain appropriate human oversight for situations requiring judgment or escalation;
  • use the service in compliance with applicable laws, regulations, industry requirements, and contractual obligations; and
  • promptly tell us about material errors or service problems that you discover.

9. Telephone Calls, Messages, Recording, and Consent

You are responsible for ensuring that your use of CallPlan complies with laws governing telephone calls, automated communications, marketing, call recording, transcription, consent, privacy, and data protection that apply to your business and callers.

If your configuration records or transcribes calls, you are responsible for providing any notice and obtaining any consent required by law. You are also responsible for determining whether automated outbound calls or messages are legally permitted for your intended use.

You may not use the service to make unlawful robocalls, send unlawful marketing communications, impersonate another person or organization, mislead callers about material facts, or engage in fraudulent, deceptive, abusive, or harassing conduct.

10. Third-Party Services and Integrations

CallPlan may rely on or integrate with third-party services such as telecommunications providers, AI model providers, scheduling platforms, payment processors, email systems, hosting providers, and other software services. Your use of those features may also be subject to the third party's terms and policies.

Recapito is not responsible for an interruption, change, restriction, or failure caused solely by a third-party service outside our reasonable control. We may substitute or modify third-party providers when reasonably necessary to operate or improve the service.

11. Service Availability and Changes

We work to provide reliable service, but continuous or error-free operation cannot be guaranteed. Maintenance, internet failures, telecommunications outages, third-party failures, security incidents, updates, or events outside our reasonable control may affect service.

We may perform maintenance or make technical changes where reasonably necessary for security, reliability, legal compliance, or product improvement.

12. Support

If you experience an issue with your CallPlan service, contact us through the website contact form or through the contact options provided at CallPlan.net.

We will respond to support requests received through our designated support channels within 24 hours, and frequently sooner. Response time means the time to acknowledge and begin addressing the request. The time required to fully resolve an issue may depend on its nature, complexity, third-party systems, and other circumstances.

13. Acceptable Use

You may not use the services to:

  • violate applicable law or another person's rights;
  • facilitate fraud, scams, phishing, unlawful discrimination, threats, harassment, or abuse;
  • transmit malware or attempt unauthorized access to systems or data;
  • circumvent service limits, billing controls, security measures, or access restrictions;
  • use the service for emergency dispatch or other uses where a service error could reasonably create an immediate risk of death or serious physical injury; or
  • use the service in a manner that materially interferes with its operation or the use of the service by others.

We may suspend or restrict service where reasonably necessary to stop unlawful activity, protect users or systems, address security concerns, or prevent material abuse.

14. Intellectual Property and Customer Information

Recapito and its licensors retain ownership of the CallPlan platform, software, workflows, configuration systems, interfaces, documentation, branding, and other technology used to provide the services.

You retain ownership of business information, materials, trademarks, and other content that you provide to us. You grant Recapito permission to use that information as reasonably necessary to configure, operate, support, secure, and improve the services you request.

15. Disclaimers

Except for obligations expressly stated in these Terms, the services are provided on an "as available" basis. To the maximum extent permitted by law, Recapito disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that an AI agent will answer every question correctly, understand every caller, complete every requested task, successfully transfer every call, or operate without interruption. You are responsible for testing and supervising the service as described in these Terms.

16. Limitation of Liability

To the maximum extent permitted by law, Recapito will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, loss of goodwill, or loss of data arising from or related to the services.

To the maximum extent permitted by law, Recapito's aggregate liability arising out of or relating to the services or these Terms will not exceed the amount you paid to Recapito for the affected service during the three months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability. Where those rules apply, these limitations apply only to the extent legally permitted.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold Recapito harmless from third-party claims, damages, penalties, costs, or expenses arising from your unlawful use of the services, information or instructions you provide, your violation of these Terms, or your failure to obtain legally required permissions or consents for calls, messages, recordings, or other communications.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, technology, or legal requirements. When we make material changes, we will update the "Last updated" date and provide additional notice when reasonably appropriate.

Your continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

19. Suspension and Termination

You may stop using the service and cancel your subscription as described above. Recapito may suspend or terminate service for material breach of these Terms, unlawful use, nonpayment, security risk, abuse of the service, or where continued service would create material legal or operational risk.

Where reasonably practical, we will provide notice and an opportunity to address the issue before termination, except where immediate action is necessary for security, legal compliance, fraud prevention, or the protection of users or third parties.
